| dc.description.abstract | Os números de violência contra a mulher no Brasil são alarmantes, indicando a necessidade de combate da sociedade e das instituições contra esse tipo de violência. O presente trabalho propõe-se adentrar nas conquistas e avanços alcançados ao longo do tempo na história do direito brasileiro no propósito específico de resguardar a dignidade e integridade física da mulher no seu âmbito doméstico e familiar, sobretudo a partir da edição da Lei 11.340 de 2006, nacionalmente conhecida como Lei Maria da Penha, identificando os tipos de violência contra a mulher nela dispostos, além de debater sobre as ferramentas legais e aparatos jurídicos destinados a coibir a violência doméstica e familiar no Brasil, destacando-se, as medidas protetivas aplicadas de modo a estabelecer a sua efetiva aplicabilidade. De igual maneira, pretende-se levantar os dados oficiais que desenham o mapa da violência doméstica e familiar no país, delineando os caminhos traçados pelas vítimas na busca por proteção e punição de seus abusadores e esboçando ainda as situações de violência que culminam na prática de feminicídio a fim de enriquecer o debate sobre a eficácia da Lei Maria da Penha como instrumento jurídico na defesa do direito das mulheres, do combate à violência doméstica e familiar bem como na proteção de suas vítimas. Para tanto foi utilizada a metodologia qualitativa, a partir de pesquisa bibliográfica e análise de artigos científicos dividida em três capítulos mostrando desde a evolução histórica desse tipo de violência, a legislação brasileira até as medidas legais de combate e proteção. | |
| dc.description.abstract2 | The numbers of violence against women in Brazil are alarming, indicating the need for society and institutions to combat this type of violence. This paper aims to delve into the achievements and advances made over time in the history of Brazilian law with the specific purpose of protecting the dignity and physical integrity of women in their domestic and family environment, especially since the enactment of Law 11.340 of 2006, nationally known as the Maria da Penha Law, identifying the types of violence against women provided for therein, in addition to discussing the legal tools and legal apparatuses aimed at curbing domestic and family violence in Brazil, highlighting the protective measures applied in order to establish their effective applicability. Likewise, the aim is to collect official data that outlines the map of domestic and family violence in the country, outlining the paths taken by victims in their search for protection and punishment from their abusers, and also outlining the situations of violence that culminate in the practice of feminicide in order to enrich the debate on the effectiveness of the Maria da Penha Law as a legal instrument in the defense of women's rights, in the fight against domestic and family violence, and in the protection of its victims. To this end, a qualitative methodology was used, based on bibliographic research and analysis of scientific articles divided into three chapters, showing the historical evolution of this type of violence, Brazilian legislation and legal measures to combat and protect it. | |
