dc.description.abstractA presente pesquisa tem como objetivo analisar a (in)constitucionalidade do art. 26, §2º, III da Emenda Constitucional nº 103/2019, que alterou a forma de cálculo da aposentadoria por incapacidade permanente no âmbito do Regime Geral de Previdência Social. A partir de uma abordagem teórica e jurisprudencial, examina-se se a nova sistemática viola princípios constitucionais fundamentais, especialmente a vedação ao retrocesso social e a irredutibilidade do valor dos benefícios. A pesquisa parte da hipótese de que a reforma compromete o núcleo essencial do direito à previdência social ao reduzir significativamente a proteção conferida ao segurado em situação de incapacidade definitiva para o trabalho. Além da análise normativa e doutrinária, são examinadas decisões judiciais que reconhecem a inconstitucionalidade da norma reformadora em casos concretos. Conclui-se que a alteração imposta pela EC nº 103/2019 representa um retrocesso social inadmissível à luz da Constituição de 1988, exigindo uma atuação vigilante do Poder Judiciário na preservação dos direitos sociais fundamentais.
dc.description.abstract2This research aims to analyze the (un)constitutionality of article 26, paragraph 2, item III of Constitutional Amendment No. 103/2019, which changed the calculation method of the permanent disability retirement benefit within the General Social Security Regime in Brazil. Through a theoretical and jurisprudential approach, the study examines whether the new rules violate fundamental constitutional principles, especially the prohibition of social retrogression and the non-reducibility of benefit values. The research is based on the hypothesis that the reform compromises the essential core of the right to social security by significantly reducing protection for insured individuals who are permanently unable to work. In addition to normative and doctrinal analysis, judicial decisions that declare the unconstitutionality of the reformative provision in concrete cases are also examined. It is concluded that the change introduced by Constitutional Amendment No. 103/2019 constitutes a social setback incompatible with the 1988 Federal Constitution, requiring the Judiciary to play an active role in safeguarding fundamental social rights.
