dc.description.abstractA presente monografia propõe uma análise crítica e cética acerca da real efetividade das penas criminais no cumprimento de seus objetivos declarados, investigando as complexas interações entre o sistema penal, a sociedade e o indivíduo condenado. Busca-se, para além da norma escrita, compreender o quanto a prática penal se distancia da teoria, especialmente no que diz respeito à função preventiva, que deveria não só prevenir crimes, mas também promover a ressocialização do condenado. A metodologia adotada consiste em revisão bibliográfica, documental e análise de dados empíricos extraídos de estudos criminológicos, legislação e jurisprudência penal brasileira. Os resultados obtidos evidenciam falhas estruturais, contradições no discurso jurídico e a ineficácia do sistema carcerário nacional em alcançar suas funções ditas preventivas. Conclui-se, assim, pela urgência de se repensar o papel das penas e de se buscar alternativas penais mais eficazes e humanas para a prevenção da criminalidade e a reinserção social dos indivíduos.
dc.description.abstract2This monograph proposes a critical and skeptical analysis of the real effectiveness of criminal penalties in fulfilling their stated objectives, investigating the complex interactions between the penal system, society and the convicted individual. It seeks, beyond the written norm, to understand how much penal practice distances itself from theory, especially with regard to the preventive function, which should not only prevent crimes, but also promote the reintegration of the convicted person into society. The methodology adopted consists of a bibliographic and documentary review and analysis of empirical data extracted from criminological studies, legislation and Brazilian criminal jurisprudence. The results obtained highlight structural flaws, contradictions in the legal discourse and the ineffectiveness of the national prison system in achieving its so-called preventive functions. Thus, it is concluded that it is urgent to rethink the role of penalties and to seek more effective and humane penal alternatives for the prevention of crime and the social reintegration of individuals.
