Violência obstétrica: um crime culturalmente neutralizado.

| dc.description.abstract | A violência obstétrica é cometida contra as mulheres em um momento muito vulnerável em suas vidas, para muitas os momentos mais felizes e realizadores, o momento da gestação. Essa violência pode ocorrer em todo o período gestacional, desde o pré-natal, até o pós-parto, e até mesmo em casos de aborto. Sua prática pode ocorrer de várias formas, podendo trazer várias consequências para a vítima. O objetivo principal do presente trabalho é discutir a violência obstétrica decorrente de erro do médico, que deve ser analisado e punido, com base no ordenamento jurídico brasileiro. Tendo como objetivos específicos, a fim de atingi o objetivo principal, os seguintes: a) Analisar a história do parto; b) Caracterizar a violência obstétrica; c) Analisar as garantias dos direitos fundamentais das parturientes; d) Discutir a violência obstétrica como uma violência de gênero; e) Analisar a conduta médica, e discutir se há responsabilização e se cabe uma legislação específica. Observa-se que tal violência fere diversos princípios fundamentais garantidos à mulher gestante, presentes na Constituição Federal de 1988, como por exemplo, o princípio da dignidade humana. Infelizmente, muitas parturientes não conhecem seus direitos e acabam por não buscarem a punição de seus agressores, seja por medo ou por falta de conhecimento, contribuindo ainda para que os médicos continuem com essas práticas e atinjam ainda mais mulheres. | |
| dc.description.abstract2 | Obstetric violence is committed against women at a very vulnerable time in their lives, for many the happiest and most fulfilling moments, the moment of pregnancy. This violence can occur throughout the gestational period, from prenatal to postpartum, and even in cases of abortion. Its practice can occur in several ways and can bring several consequences to the victim. The main objective of this paper is to discuss obstetric violence resulting from medical error, which must be analyzed and punished, based on the Brazilian legal system. To achieve the main objective, the specific objectives are as follows: a) Analyze the history of childbirth; b) Characterize obstetric violence; c) Analyze the guarantees of fundamental rights of women in labor; d) Discuss obstetric violence as gender violence; e) Analyze the medical conduct, and discuss whether there is accountability and whether it fits specific legislation. It is observed that such violence hurts several fundamental principles guaranteed to pregnant women, present in the Federal Constitution of 1988, such as the principle of human dignity. Unfortunately, many parturients do not know their rights and end up not seeking the punishment of their aggressors, either by fear or by lack of knowledge, further contributing to the continuation of these practices by doctors and reaching even more women. | |
