dc.description.abstractAs secas extremas que afetam ciclicamente o semiárido brasileiro, especialmente nas áreas de sequeiro do Sertão do São Francisco, revelam uma crise multidimensional com profundas implicações sociais, econômicas, ambientais e jurídicas. A persistente vulnerabilidade dos agricultores de subsistência, agravada pelas mudanças climáticas e pela omissão histórica do Estado, evidencia um cenário de injustiça estrutural e exclusão social. Este trabalho tem como objetivo analisar os impactos jurídicos das secas extremas sobre esses grupos, com ênfase na proteção legal dos agricultores e na garantia de seus direitos fundamentais. A pesquisa adota uma abordagem interdisciplinar, articulando o Direito Constitucional, o Direito Ambiental, o Direito Agrário e os Direitos Humanos, para avaliar criticamente o arcabouço normativo existente e a eficácia das políticas públicas voltadas ao semiárido. Para tanto, optou-se pelo método qualitativo com análise doutrinária e normativa. Estruturado em três capítulos, o estudo aborda o conceito de Estado de Coisas Inconstitucional, a legislação aplicável e as alternativas de enfrentamento da crise, propondo medidas sustentáveis e integradas. Conclui-se que a superação dos efeitos das secas exige não apenas infraestrutura hídrica, mas também o reconhecimento do direito à água como direito humano essencial e a implementação de políticas públicas estruturantes que assegurem a justiça socioambiental e a permanência digna do agricultor em seu território.
dc.description.abstract2Extreme droughts that cyclically affect Brazil's semi-arid region, particularly the rainfed areas of the São Francisco Sertão, represent a complex crisis with significant social, economic, environmental, and legal implications. The continued vulnerability of subsistence farmers, worsened by climate change and the State's historical neglect, reflects deep-rooted structural injustices and an exclusionary development model. This study aims to analyze the legal impacts of extreme droughts on these populations, with a focus on their legal protection and the guarantee of fundamental rights. Adopting an interdisciplinary approach, the research interrelates Constitutional Law, Environmental Law, Agrarian Law, and Human Rights to critically assess the existing legal framework and the effectiveness of public policies directed at the semi-arid region. Structured in three chapters, the study explores the concept of an Unconstitutional State of Affairs (ECI), examines relevant legislation, and presents legal alternatives to address the crisis, emphasizing sustainable water use, river transposition projects, support for family farming, and climate-adapted social technologies. The study concludes that addressing extreme droughts requires more than infrastructure; it demands recognition of water as a fundamental human right and the implementation of integrated, participatory public policies that promote socio-environmental justice and ensure the dignified permanence of farmers in their territories.
