Homeschooling no Brasil: uma crítica acerca das inconsistências sociais e jurídicas da regulamentação da educação domiciliar no contexto brasileiro.

| dc.description.abstract | A educação domiciliar é entendida como o ensino realizado no âmbito doméstico sob mediação dos pais ou responsáveis legais. Tornou-se um tema relevante no Brasil especialmente a partir da segunda década do séc. XXI e passou a ganhar destaque pelos pais e responsáveis de todo o país. Apesar de ser adotada por um grande número de famílias, a prática é tida como ilegal dentro do território nacional, vez que precisa de regulamentação legal para ser institucionalizada. Diante da ilegalidade, projetos de lei foram propostos a fim de legalizar o modelo de ensino, todavia, pouco se discute sobre os impactos negativos que ele pode causar. Nesse sentido, o presente trabalho se propõe a verificar as inconsistências da adoção dessa prática no Brasil. Para tanto, pretende responder o seguinte questionamento: quais seriam os impactos negativos que a regulamentação da educação domiciliar no Brasil geraria? Nesse interim, objetiva-se: contextualizar o método de ensino denominado homeschooling; analisar o tratamento jurídico que a prática recebe na atualidade; perscrutar os projetos de lei propostos após a aprovação da Lei de Diretrizes e Bases da Educação Nacional a fim de permitir a educação domiciliar; e, por fim, verificar os perigos desse método estudantil no Brasil. A fim de cumprir com os objetivos, serão analisados autores como John Holt, Raymond e Dorothy Moore, Rousas J. Rushdoony, Fausto Zamboni, Georges Bataille, Washington Drummond etc. Ademais, analisar-se-á a legislação atinente ao tema, especialmente a Constituição Federal, a Lei de Diretrizes e Bases da Educação Nacional e o Estatuto da Criança e do Adolescente. Não menos importante, explorar-se-á as discussões judiciais acerca do homeschooling, com foco no RE 888.815/RS. Adota-se, para a construção deste trabalho, o método dedutivo através de uma abordagem qualitativa e da revisão bibliográfica de artigos, livros, ensaios científicos, legislações e decisões judiciais. Percebe-se, ao final, que a educação domiciliar é um método cheio problemáticas extremamentes sensíveis para ser aplicado em um país de dimensões continentais. Entende-se que seria mais interessante que os pais adotassem o modelo de afterschooling, posto que proporcionaria que o menor frequentasse a escola e tivesse a educação complementada pela família. | |
| dc.description.abstract2 | Homeschooling is understood as teaching carried out in the home environment under the mediation of parents or legal guardians. It has become a relevant topic in Brazil, especially since the second decade of the 21st century, and has gained prominence among parents and guardians throughout the country. Despite being adopted by a large number of families, the practice is considered illegal within the national territory, since it requires legal regulation to be institutionalized. Given its illegality, bills have been proposed in order to legalize the teaching model, however, little is discussed about the negative impacts it can cause. In this sense, this paper aims to verify the inconsistencies of the adoption of this practice in Brazil. To this end, it intends to answer the following question: what would be the negative impacts that the regulation of homeschooling in Brazil would generate? In the meantime, the objectives are: to contextualize the teaching method called homeschooling; to analyze the legal treatment that the practice currently receives; to scrutinize the bills proposed after the approval of the Law of Guidelines and Bases of National Education in order to allow homeschooling; and, finally, to verify the dangers of this student method in Brazil. In order to fulfill the objectives, authors such as John Holt, Raymond and Dorothy Moore, Rousas J. Rushdoony, Fausto Zamboni, Georges Bataille, Washington Drummond, etc. will be analyzed. In addition, the legislation related to the subject will be analyzed, especially the Federal Constitution, the Law of Guidelines and Bases of National Education and the Statute of the Child and Adolescent. No less important, the judicial discussions about homeschooling will be explored, focusing on RE 888.815/RS. The deductive method was adopted to construct this work through a qualitative approach and bibliographic review of articles, books, scientific essays, legislation and judicial decisions. In the end, it is clear that homeschooling is a method full of extremely sensitive problems to be applied in a country of continental dimensions. It is understood that it would be more interesting for parents to adopt the afterschooling model, since it would allow the child to attend school and have their education complemented by the family. | |
