dc.description.abstractA presente pesquisa tem como objetivo geral analisar a legalidade e a legitimidade do uso da infiltração de agentes policiais como meio de obtenção de provas nas ações penais para a apuração dos crimes sexuais praticados contra menores por meio do aparato tecnológico. Já os objetivos específicos consistem em: apresentar os crimes sexuais praticados contra menores em ambiente virtual; demonstrar o uso da infiltração de agentes policiais como meio de obtenção de provas e verificar a legalidade e a legitimidade do uso da infiltração de agentes policiais na apuração de crimes sexuais praticados contra menores por meio de ambiente virtual. Para tanto, realiza-se uma contextualização histórica da legislação autorizativa da infiltração policial até o presente momento, quando se tem a infiltração virtual de agente policial para a coibição de crimes praticados por meio da internet contra crianças e adolescentes, deixando claro que a utilização do instituto é uma técnica investigativa excepcional que deve ser utilizada apenas quando não houver outros meios de obtenção de provas. O trabalho apresenta os requisitos necessários para a sua utilização bem como, as pessoas que possuem legitimidade para solicitá-la. Além disso, é realizada uma análise crítica da legislação apontando algumas falhas e situações em que a Lei silencia com o apontamento de riscos tanto para o agente infiltrado, como também para terceiros. Por fim, é procedida à análise de três entendimentos judiciais sobre a infiltração policial, em que foram encontradas situações que corroboram as críticas de alguns doutrinadores, especialmente, quando falam sobre a necessidade de maiores detalhamentos quanto ao procedimento propriamente dito.
dc.description.abstract2This present research has as the general goal to analyze the legality and legitimacy on the use of infiltration of police agents as a mean of getting proof on penal actions to the investigation of sexual crimes against minors through technological tools. The specific objectives consist of: present the sexual crimes against minors in virtual environment; demonstrate the use of infiltration of agency as a mean of getting proof and verify the legality and legitimacy on the use of infiltration of police agents on investigation of sexual crimes against minors through virtual environment. To this end, a historical contextualization authoritative of police infiltration was conducted until the present moment when there is virtual infiltration of the police agent to prevent crimes committed through internet against children and teenagers, making it clear that use of the police infiltration institute is an exceptional investigative technique and should only be used when there are no other means of obtaining evidence. This research presents the necessary requirements for its use, as well as the people who have the legitimacy to request it. A critical analysis of the legislation is carried out, pointing out some flaws and situations in which the law is silent on pointing out risks both for the undercover agent and for third parties. In conclusion, the analysis of three judicial understandings on judicial infiltration is performed, in which situations were found that corroborate the criticisms of some scholars, especially when they talk about the need for greater details regarding the procedure itself.
