| dc.description.abstract | A pesquisa se funda nas mudanças que vem ocorrendo na formação da família contemporânea, observando o conceito de entidade familiar, que já não é mais limitada à união entre o homem e a mulher, com o objetivo de reprodução, mas, o desenvolvimento das uniões homoafetivas com recorte especial para as possibilidades de adoção, o que asseguraria a continuidade da família, reconhecendo, porém, a grande polêmica em torno de tal tema. O enfoque estará no instituto da adoção dentro ordenamento jurídico brasileiro, através do ECA, das mudanças advindas da Nova Lei da Adoção 12010/09, e de outros dispositivos legais, considerando a importância de sua base principiológica, de decisões do STF e, sem deixar de apontar a omissão do Poder Legislativo Federal, que não se debruçou até então, em apresentar uma lei expressa que regulamente essa modalidade de adoção. Será utilizado o método dedutivo e procedimentos de pesquisa documental e bibliográfica para mostrar que, embora tenham havido transformações e avanços no posicionamento da justiça pátria, ainda permanece a necessidade de que, as Ciências Jurídicas, regulamentadoras das relações sociais e dos Direitos Humanos, bem como, que os Legisladores proponham leis que privilegiem os interesses das muitas crianças e adolescentes que se encontram em desamparo e sem um lar permanente, e que podem encontrar no seio de uma família homoafetiva, condição de vida digna, afeto e desenvolvimento. | |
| dc.description.abstract2 | The research is based on the changes that have been taking place in the formation of the contemporary family, observing the concept of a family entity, which is no longer limited to the union between a man and a woman, with the objective of reproduction, but the development of homoaffective unions. with a special focus on the possibilities of adoption, which would ensure the continuity of the family, recognizing, however, the great controversy surrounding this topic. The focus will be on the institute of adoption within the Brazilian legal system, through the ECA, the changes arising from the New Adoption Law 12010/09, and other legal provisions, considering the importance of its principled basis, decisions of the STF and, without leaving to point out the omission of the Federal Legislative Power, which until then had not addressed itself, in presenting an express law that regulates this modality of adoption. The deductive method and documentary and bibliographical research procedures will be used to show that, although there have been transformations and advances in the positioning of national justice, the need still remains that the Legal Sciences, which regulate social relations and Human Rights, as well as , that the Legislators propose laws that favor the interests of the many children and adolescents who find themselves in abandonment and without a permanent home, and who can find in the bosom of a homoaffective family, a dignified life condition, affection and development.
