dc.description.abstractO financiamento é um importante componente do sistema de saúde. O SUS enfrenta um subfinanciamento desde a sua criação. Esse estudo objetiva analisar a construção da Emenda Constitucional (EC) N° 95/2016 para o financiamento da saúde no Legislativo Federal do Brasil. As principais tomadas de posição realizadas pelos parlamentares foram mapeadas e suas trajetórias analisadas. A PEC do teto dos gastos públicos buscou congelar os gastos em saúde durante 20 anos, tramitou no Congresso em 6 meses e foi aprovada nas duas Casas. O referencial teórico adoto para o estudo foi a sociologia reflexiva e genética de Pierre Bourdieu. Trata-se de um estudo documental, analítico, com abordagem qualitativa. Foram analisadas as Atas das Sessões de votação da EC, buscou-se retratar a dinâmica do jogo social na relação entre grupos, as alianças formadas, o espaço dos possíveis inscritos no campo político. A trajetória dos agentes foi analisada por meio de biografias disponíveis em sites oficiais da câmara, do senado ou de instituições de ensino/pesquisa. Os principais conflitos mapeados durante as discursões e votação da emenda, entre parlamentares da base do governo e da oposição foram sobre a (in) constitucionalidade da PEC, a retirada de direitos sociais, o (sub) financiamento da saúde, e as justificativas pessoais/partidárias para a tomada de posição. O Governo afirmava que a PEC aumentaria os recursos da saúde, que não haveria teto, mas sim um piso que poderia ser aumentado caso houvesse necessidade, e culpou o PT pela crise econômica pela qual o país estava passando. Já a Oposição argumentou a inconstitucionalidade da proposta, previu quedas no orçamento do SUS e alertou para o aumento das desigualdades sociais. Diversas projeções, à época já previam o aumento do subfinanciamento da saúde pública, estima-se que entre os anos de 2018 e 2022, o SUS perdeu aproximadamente R$ 37 bilhões. Assim, o Poder Legislativo vem atuando de forma inconsistente com o polo universal e segmentada, na dependência de demandas do Executivo quando o tema é saúde, contribuindo para perdurar o subfinanciamento crônico do SUS e induzir a mercantilização da saúde. O fortalecimento do orçamento da saúde faz-se urgente e só será possível por meio da retomada do projeto constitucional da seguridade social com definições claras para a saúde.
dc.description.abstract2Financing is an important component of the health system. The SUS has faced underfunding since its inception. This study aims to analyze the construction of the Constitutional Amendment N° 95/2016 for health financing in the Federal Legislative of Brazil. The main positions taken by parliamentarians were mapped and their trajectories analyzed. The Constitutional Amendment sought to freeze health spending for 20 years, passed Congress in 6 months and was approved in both Houses. The theoretical framework adopted for the study was Pierre Bourdieu's reflective and genetic sociology. This is a documentary, analytical study with a qualitative approach. The Minutes of the Voting Sessions of the Constitutional Amendment were analyzed, with the aim of portraying the dynamics of the social game in the relationship between groups, the alliances formed, the space of possible subscribers in the political field. The trajectory of the agents was analyzed through biographies available on official websites of the Legislative or teaching/research institutions. The main conflicts mapped during the speeches and voting on the amendment, between parliamentarians from the government base and the opposition were about the constitutionality of the amendment, the withdrawal of social rights, health financing, and the personal/partisan justifications for taking a position. The Government claimed that the amendment would increase health resources, that there would be no ceiling, but a floor that could be increased if necessary, and blamed the PT for the economic crisis the country was going through. The Opposition, on the other hand, argued the unconstitutionality of the proposal, predicted falls in the SUS budget and warned of the increase in social inequalities. Several projections, at the time, already predicted an increase in public health underfunding, it is estimated that between 2018 and 2022, SUS lost approximately R$ 37 bilion. Thus, the Legislative has been acting inconsistently with the universal and segmented pole, depending on the demands of the Executive when the subject is health, contributing to the persistence of the chronic underfunding of the SUS and inducing the commodification of health. Strengthening the health budget is urgent and will only be possible through the resumption of the constitutional project of social security with clear definitions for health.
