| dc.description.abstract | Minha experiência social como homem negro, de origem pobre, somada à experiência coletiva daquelas pessoas que compartilham comigo as mesmas características e vivências, me permitem interpretar o mundo a partir de outras lentes, me permitem fazer uma leitura do Direito que não a realizada tradicionalmente. O presente trabalho tem o escopo de analisar e descrever de que modo minhas escrevivências a partir do Rap Negro Drama, enquanto jurista negro, podem contribuir para uma Hermenêutica Jurídica Negra, articulando com perspectivas teóricas fundamentais. Para tanto, desenvolvo nesta pesquisa, o método do storytelling, uma das premissas da Teoria Crítica da Raça, aliada à perspectiva de escrevivência de Conceição Evaristo, articulando princípios jurídicos, perspectivas hermenêuticas e as minhas narrativas pessoais, como membro de um grupo racial e enquanto ouvinte do Rap, como forma de desvelamento do sentido das normas jurídicas, reconhecendo o meu lugar de fala na hermenêutica jurídica, o meu lócus social, constituído por discriminações sistemáticas, institucionais, intergeracionais e estruturais. A hermenêutica jurídica tradicional é pautada na suposta universalidade jurídica e neutralidade racial, que retroalimenta os interesses da branquitude, ao tomar para si, por si e em si, o monopólio de interpretação jurídica, representando o paradigma de humanidade, o modelo de sujeito de direito, a norma, a normalidade e a segurança do sujeito universal e universalizante. Por conseguinte, a relevância da investigação se justifica em virtude da necessidade de se construir a ideia e o ideal de justiça e de um Direito Achado e Encontrado no Rap, na Rua, na Negritude. A virada hermenêutica/linguística/epistemológica é elementar para construção crítica de um projeto político-jurídico de efetivação de direitos fundamentais, na luta por justiça racial e cognitiva, da pluriversalização do Direito, por meio de outro horizonte jurídico, histórico, filosófico, ontológico, interseccional, orientado por uma Crítica da Razão Negra, como conceito e lente para lermos o mundo. Portanto, o rolê epistemológico deste trabalho vem questionar o “Penso, logo Existo” cartesiano, e transformar num Penso, Logo Rimo, a partir de um saber, de corpo e mente, enquanto potência elucidativa, epistêmica e hermenêutica, de um jurista negro que escreve uma concepção de Direito da Ponte Pra Cá do positivismo jurídico. | pt_BR |
| dc.description.abstract2 | My social experience as a black man, of poor origin, added to the collective experience of those people who share the same characteristics and experiences with me, allow me to interpret the world from other lenses, allow me to read the Law that is not traditionally done. The present work has the scope to analyze and describe how my writings from Rap Negro Drama, as a black jurist, can contribute to a Black Legal Hermeneutics, articulating with fundamental theoretical perspectives. Therefore, in this research, I develop the storytelling method, one of the premises of the Critical Theory of Race, allied to Conceição Evaristo's writing perspective, articulating legal principles, hermeneutic perspectives and my personal narratives, as a member of a racial group and as a Rap listener, as a way of revealing the meaning of legal norms, recognizing my place of speech in legal hermeneutics, my social locus, constituted by systematic, institutional, intergenerational and structural discrimination. Traditional legal hermeneutics is based on the supposed legal universality and racial neutrality, which feeds back the interests of whiteness, by taking for itself, for itself and in itself, the monopoly of legal interpretation, representing the paradigm of humanity, the model of subject of law, the norm, normality and security of the universal and universalizing subject. Therefore, the relevance of the investigation is justified due to the need to build the idea and ideal of justice and a Right Found and Found in Rap, in the Street, in Negritude. The hermeneutic/linguistic/epistemological turn is essential for the critical construction of a political-legal project for the realization of fundamental rights, in the struggle for racial and cognitive justice, for the pluriversalization of Law, through another legal, historical, philosophical, ontological, intersectional, guided by a Critique of Black Reason, as a concept and lens for reading the world. Therefore, the epistemological role of this work comes to question the Cartesian “I think, therefore I exist”, and to transform it into a I Think, Logo Rhyme, from a knowledge, of body and mind, as an elucidative, epistemic and hermeneutic power, of a black jurist who writes a conception of Law From the Bridge to Here of legal positivism. | |
