dc.description.abstractO presente trabalho tem como objetivo analisar os aspectos jurídicos do limbo previdenciário trabalhista. Essa condição evidencia um vácuo legal e provoca relevantes consequências sociais e jurídicas, especialmente no que se refere à proteção do trabalhador, à responsabilidade do empregador e à atuação do Estado. Realizou-se pesquisa qualitativa, com enfoque exploratório-descritivo, e fundamentada em revisão bibliográfica, análise documental (normas, súmulas e instruções normativas) e exame de jurisprudência do Tribunal Superior do Trabalho (TST). A abordagem teórica contemplou autores como Maurício Godinho Delgado e Frederico Amado, além da legislação vigente, especialmente a Constituição Federal, a Consolidação das Leis do Trabalho (CLT) e a Lei nº 8.213/1991. Como resultados, foi verificada a ausência de regulamentação específica sobre o tema, a insegurança jurídica que isso provoca tanto para empregados quanto para empregadores, e a necessidade de uma atuação mais eficaz do Estado, seja por meio da criação de norma legal específica, seja pela atuação articulada entre a Justiça do Trabalho e o INSS. Também foram pontadas alternativas jurídicas e institucionais para mitigar os efeitos do limbo, com base na jurisprudência e nos princípios constitucionais.
dc.description.abstract2The present paper aims to analyze the legal aspects of the so-called “previdenciary labor limbo.” This condition highlights a legal vacuum and brings about significant social and legal consequences, especially regarding worker protection, employer responsibility, and the role of the State. A qualitative study was carried out, with an exploratory-descriptive approach, based on a bibliographic review, documentary analysis (including regulations, legal precedents, and normative instructions), and an examination of case law from the Superior Labor Court (TST). The theoretical framework considered authors such as Maurício Godinho Delgado and Frederico Amado, in addition to the current legislation, especially the Federal Constitution, the Consolidation of Labor Laws (CLT), and Law no. 8,213/1991. As results, the study identified the absence of specific regulation on the subject, the resulting legal uncertainty for both employees and employers, and the need for a more effective action from the State, either through the creation of specific legal norms or through coordinated action between the Labor Court and the National Institute of Social Security (INSS). The paper also pointed out legal and institutional alternatives to mitigate the effects of the limbo, based on case law and constitutional principles.
