dc.description.abstractA presente monografia objetiva realizar uma crítica à ausência da função social da propriedade como um dos pré-requisitos para concessão de tutela nas ações possessórias coletivas. Por meio de revisão bibliográfica, este estudo busca definir o direito de posse, explicar como se dá seu exercício de forma coletiva, bem como demonstrar a forma de sua proteção por meio das ações possessórias coletivas previstas no Código de Processo Civil. Em sequência, debruça-se sobre o princípio constitucional da função social da propriedade, buscando compreender a sua relação com os direitos de propriedade e de posse e demonstrar a sua essencialidade na efetivação de outros direitos fundamentais como moradia, trabalho e dignidade humana. Por fim, são apresentados argumentos que evidenciam como a ausência da exigência da perquirição sobre o preenchimento da função social da propriedade na concessão de tutela possessória coletiva revela-se contraditória dentro do ordenamento jurídico brasileiro, indicando a necessidade de evolução da legislação e da atuação do próprio Poder Judiciário para que esse critério seja devidamente incorporado nessas ações.
dc.description.abstract2This monograph aims to criticize the absence of the requirement to analyze the social function of property as one of the prerequisites for granting relief in collective possessory actions.Through a bibliographic review, this study seeks to define the right of possession, explain how it is exercised collectively, and demonstrate how it is protected through collective possessory actions provided for in the Code of Civil Procedure. Subsequently, the research examines the constitutional principle of the social function of property, seeking to understand its relationship with the rights of property and possession and to demonstrate its essential role in the realization of other fundamental rights, such as housing, work, and human dignity. Finally, arguments are presented to demonstrate how the absence of a requirement to investigate the fulfillment of the social function of property in the granting of collective possessory relief proves to be contradictory within the Brazilian legal system, indicating the need for the evolution of legislation and the role of the Judiciary itself so that this criterion may be properly incorporated into such actions.
