| dc.description.abstract | A prisão preventiva é um recurso legal destinado a preservar a ordem pública, garantir a instrução criminal e assegurar a aplicação da lei penal. No entanto, a utilização excessiva e inadequada desse instituto tem suscitado debates sobre suas repercussões no sistema jurídico e nas pessoas envolvidas. Em primeiro lugar, é fundamental compreender o conceito e os fundamentos jurídicos da prisão preventiva, que incluem a necessidade de evitar a continuidade de crimes, preservar provas e garantir a efetividade das decisões judiciais. No entanto, a banalização desse recurso ocorre quando ele é aplicado de forma indiscriminada, sem observar os requisitos legais e sem uma fundamentação adequada. Os impactos negativos da banalização da prisão preventiva são diversos. Em muitos casos, ela contribui para a superlotação carcerária, violando os direitos fundamentais dos acusados e gerando um processo penal moroso e pouco eficiente. Além disso, a banalização da prisão preventiva pode levar à descrença na justiça, prejudicando a credibilidade do sistema jurídico como um todo. Para mitigar esses impactos, é necessário adotar medidas que promovam uma aplicação mais criteriosa da prisão preventiva. Isso inclui revisar os critérios de sua utilização, incentivar o uso de medidas cautelares alternativas, melhorar as condições nos presídios e fortalecer os mecanismos de controle e fiscalização. | |
| dc.description.abstract2 | Pretrial detention is a legal remedy designed to preserve public order, ensure criminal investigation and ensure the application of criminal law. However, the excessive and inappropriate use of this institution has sparked debates about its repercussions on the legal system and the individuals involved. First, it is essential to understand the concept and legal foundations of pretrial detention, which include the need to prevent the continuation of crimes, preserve evidence and ensure the effectiveness of judicial decisions. However, this remedy becomes trivial when it is applied indiscriminately, without observing legal requirements and without adequate justification. The negative impacts of the trivialization of pretrial detention are diverse. In many cases, it contributes to prison overcrowding, violating the fundamental rights of defendants and generating a slow and inefficient criminal process. Furthermore, the trivialization of pretrial detention can lead to distrust in justice, damaging the credibility of the legal system as a whole. To mitigate these impacts, it is necessary to adopt measures that promote a more judicious application of pretrial detention. This includes reviewing the criteria for their use, encouraging the use of alternative precautionary measures, improving conditions in prisons and strengthening control and oversight mechanisms. | |
