dc.description.abstractO acesso limitado ao Benefício de Prestação Continuada (BPC) para pessoas com deficiência física e transtorno mental em Itaberaba, no período de 2022 a 2023, apresenta desafios significativos que afetam a inclusão e proteção social desses indivíduos. Esta pesquisa tem como objetivo investigar esses desafios, visando contribuir para a promoção da inclusão e igualdade de oportunidades. Por meio da pergunta provocadora: “Quais são os principais desafios enfrentados pelas pessoas com deficiência física e transtorno mental no município de Itaberaba, de 2022 a 2023, no que diz respeito ao acesso ao Benefício de Prestação Continuada (BPC)?", busca se compreender as barreiras enfrentadas por este grupo específico. Os objetivos específicos incluem analisar o processo de solicitação e obtenção do BPC, identificando as principais barreiras burocráticas; investigar a avaliação de deficiência realizada no município e sua efetividade na determinação do direito ao benefício; investigar se existem, no INSS de Itaberaba, médicos especializados para atender as pessoas com deficiência física e/ou mental; identificar os impactos do estigma e da discriminação na solicitação e obtenção do BPC.  A pesquisa justifica-se pela necessidade de abordar as desigualdades e violações de direitos presentes no acesso limitado ao BPC. Com base em uma fundamentação teórica sólida, que abrange a teoria dos direitos humanos, a teoria da inclusão social, a teoria da discriminação e estigma, e a teoria das políticas públicas, pretende-se compreender e analisar o fenômeno em questão. Trata-se o referido benefício, BPC, de um direito previsto no art. 203, V da CRFB/88, e no art. 20, parágrafo 3° da lei 8.742/93, LOAS (Lei Orgânica de Assistência Social), além de estar contemplado pelos princípios constitucionais da Igualdade e da Dignidade da Pessoa Humana, daí a sua relevância jurídica. A metodologia adotada abrange uma abordagem qualitativa e quantitativa. A revisão bibliográfica embasará o estudo, enquanto a coleta de dados primários envolverá entrevistas com profissionais e atores envolvidos no processo. A análise documental examinará regulamentos e legislação relacionados ao benefício, e a análise dos dados estatísticos fornecerá informações quantitativas. A interpretação dos resultados será realizada à luz das teorias selecionadas, culminando na proposição de recomendações para aprimorar o acesso ao BPC em Itaberaba. Com essa pesquisa, busca-se contribuir para a compreensão dos desafios enfrentados pelos indivíduos com deficiência física e transtorno mental no acesso ao BPC, a fim de promover políticas públicas mais eficazes, favorecer a inclusão e garantir a igualdade de oportunidades em Itaberaba. Este trabalho foi elaborado em quatro capítulos, mais cinco subtópicos, versando sobre alguns princípios constitucionais norteadores, além de uma abordagem sobre o BPC, a Assistência Social, discussões acerca dos requisitos inerentes à concessão do aludido benefício, bem como alguns esclarecimentos sobre a condição de miserabilidade. Como resultado final, constatou se serem reais os variados obstáculos enfrentados pelos deficientes quando da tentativa de inserção ao BPC.
dc.description.abstract2Limited access to the Continued Provision Benefit (BPC) for people with physical disabilities and mental disorders in Itaberaba, from 2022 to 2023, presents significant challenges that affect the inclusion and social protection of these individuals. This research aims to investigate these challenges, aiming to contribute to the promotion of inclusion and equal opportunities. Through the provocative question: “What are the main challenges faced by people with physical disabilities and mental disorders in the municipality of Itaberaba, from 2022 to 2023, with regard to access to the Continuous Provision Benefit (BPC)?” to understand the barriers faced by this specific group. The specific objectives include analyzing the process of requesting and obtaining the BPC, identifying the main bureaucratic barriers; investigating the disability assessment carried out in the municipality and its effectiveness in determining the right to the benefit; investigating whether there are, in the INSS of Itaberaba, specialized doctors to assist people with physical and/or mental disabilities; identify the impacts of stigma and discrimination in requesting and obtaining the BPC. The research is justified by the need to address inequalities and violations of rights present in the limited access to the BPC. Based on a solid theoretical foundation, which covers the theory of human rights, the theory of social inclusion, the theory of discrimination and stigma, and the theory of public policies, it is intended to understand and analyze the phenomenon in question. This benefit, BPC, is a right provided for in art. 203, V of CRFB/88, and in art. 20, paragraph 3 of Law 8.742/93, LOAS (Organic Law of Social Assistance), in addition to being contemplated by the constitutional principles of Equality and Human Dignity, hence its legal relevance. The adopted methodology covers a qualitative and quantitative approach. The bibliographic review will support the study, while the primary data collection will involve interviews with professionals and actors involved in the process. The desk review will examine regulations and legislation related to the benefit, and the analysis of statistical data will provide quantitative information. The interpretation of the results will be carried out in the light of the selected theories, culminating in the proposition of recommendations to improve access to BPC in Itaberaba. With this research, we seek to contribute to the understanding of the challenges faced by individuals with physical disabilities and mental disorders in accessing the BPC, in order to promote more effective public policies, favor inclusion and guarantee equal opportunities in Itaberaba. This work was elaborated in two chapters, plus five subtopics, dealing with some guiding constitutional principles, in addition to an approach on the BPC, Social Assistance, discussions about the requirements inherent in granting the aforementioned benefit, as well as some clarifications on the condition of misery. As a final result, it was found that the various obstacles faced by the disabled when attempting to enter the BPC were real.
