A ‘’mulher indigna’’ e a defesa da honra: um estudo sobre o caso Aridalva (Iaçu-BA, 1992)

| dc.description.abstract | A presente monografia possui como objetivo geral realizar um estudo de caso de tentativa de homicídio na cidade de Iaçu-BA no ano de 1992, a influência de estereótipos de gênero e estruturas patriarcais na condução do processo judicial, com foco na percepção das vítimas e do réu, e na ocorrência de revitimização institucional. O referido estudo é de grande relevância, tento em vista que, no Brasil o assassinato de mulheres, não raramente, ocorre através de um parceiro ou ex-parceiro da vítima. Nessa perspectiva, o presente trabalho possui como objetivos específicos discutir como a construção social de gênero e a hegemonia masculina influenciam os discursos que definem o papel da mulher na sociedade e no sistema de justiça; analisar as controvérsias do sistema penal e a revitimização de mulheres no processo criminal. Ademais, investigar a partir do caso Aridalva a aplicação da tese da legítima defesa no processo, examinando os argumentos apresentados e suas implicações. Para isso, a metodologia adotada consistiu em uma abordagem qualitativa e método empírico-indutivo. O percurso metodológico adotado se deu com a obtenção do processo por meio de terceiros, mediante acesso não institucional, mas por pessoa com acesso direto ao documento. Posteriormente foi feita a análise do inquérito policial e da demais peças processuais. Após, foi feito um resumo do processo para que fosse feito levantamento dos principais pontos que compuseram o feito e análise crítica, buscando responder à problemática proposta sob a perspectiva de gênero. Outrossim, foram utilizadas pesquisas bibliográficas a partir de artigos científicos, livros e outras fontes relevantes para a fundamentação do presente tema. Ao final do estudo, chegou-se à conclusão de que a atuação do poder judiciário frente ao combate da violência de gênero mostrou-se insuficiente, tendo em vista que em vez de proteger, proporciona revitimização de mulheres. Isto porque, ainda que rechaçada a tese da “legítima defesa da honra” os fundamentos que a permeia continuam presentes nos tribunais e intrínsecos ao contexto social, sendo um problema que ainda precisa ser lidado além do sistema de justiça criminal. | |
| dc.description.abstract2 | The general objective of this monograph is to conduct a case study of an attempted murder in the city of Iaçu, Bahia, in 1992, and it legal and social implications. This study is highly relevant, given that in Brazil, the murder of women is often committed by a partner or former partner of the victim. From this perspective, the specific objectives of this work are to discuss how the social construction of gender and male hegemony influence the discourses that define the role of women in society and the justice system; to analyze the controversies of the penal system and the revictimization of women in the criminal process. Furthermore, based on the Aridalva case, we investigate the application of the self-defense theory in the process, examining the arguments presented and their implications. To this end, the methodology adopted consisted of a qualitative approach and an empirical-inductive method. The methodological approach adopted involved obtaining the case file through third parties, through non-institutional access, but through individuals with direct access to the document. Subsequently, the police investigation and other procedural documents were analyzed. A summary of the case was then prepared to identify the main points of the case and critically analyze it, seeking to address the proposed issue from a gender perspective. Furthermore, bibliographical research from scientific articles, books, and other relevant sources was used to support this topic. At the end of the study, it was concluded that the judiciary's actions in combating gender-based violence have proven insufficient, as instead of protecting, they have revictimized women. This is because, even though the "legitimate defense of honor" thesis has been rejected, its underlying principles remain present in the courts and intrinsic to the social context, representing a problem that still needs to be addressed beyond the criminal justice system.
