dc.description.abstractA presente pesquisa tem como objetivo analisar a exposição excessiva de crianças e adolescentes na plataforma digital TikTok, à luz do princípio do melhor interesse, com foco no fenômeno do oversharenting -prática que consiste no compartilhamento excessivo da imagem dos filhos por seus responsáveis, muitas vezes com fins lucrativos. O estudo parte da constatação de que o ordenamento jurídico brasileiro carece de normatização específica sobre o tema, mesmo diante das implicações éticas, psicológicas, sociais e jurídicas que decorrem dessa exposição digital. Por meio de abordagem qualitativa, com método dedutivo e técnicas de pesquisa bibliográfica, autoral de estudo de caso, documental e jurisprudencial, o trabalho investiga os impactos da superexposição infantojuvenil no desenvolvimento psíquico, social e emocional de crianças, associando essas práticas à violação de direitos fundamentais e ao trabalho infantil disfarçado. Conclui-se pela urgência de se pensar políticas públicas e instrumentos jurídicos específicos que assegurem a proteção integral de crianças e adolescentes no ambiente digital. Para mais, sugere a criação de legislação específica sobre o tema e políticas públicas de conscientização, ao utilizar modelos legislativos que já estão surgindo nos Estados Unidos.
dc.description.abstract2This research aims to analyze the excessive exposure of children and adolescents on the digital platform TikTok, in light of the principle of best interest, focusing on the phenomenon of oversharing — a practice that consists of the excessive sharing of children's images by their guardians, often for profit. The study is based on the observation that the Brazilian legal system lacks specific regulation on the subject, even in view of the ethical, psychological, social and legal implications that arise from this digital exposure. Through a qualitative approach, with a deductive method and techniques of bibliographic, authorial, case study, documentary and jurisprudential research, the work investigates the impacts of child and adolescent overexposure on the psychological, social and emotional development of children, associating these practices with the violation of fundamental rights and disguised child labor. The conclusion is that it is urgent to consider public policies and specific legal instruments that ensure the full protection of children and adolescents in the digital environment. Furthermore, it suggests the creation of specific legislation on the subject and public awareness policies, using legislative models that are already emerging in the United States.
