dc.description.abstractO presente estudo versa sobre os limites éticos e jurídicos da utilização da imagem de pessoas falecidas por meio de inteligência artificial, especialmente com o uso da técnica deepfake, que tem possibilitado a chamada ‘’ressurreição digital’’. Parte-se da premissa de que os direitos da personalidade, embora intransmissíveis e irrenunciáveis, podem ter reflexos patrimoniais mesmo após a morte, o que levanta questionamentos sobre a legitimidade dos herdeiros na exploração econômica da imagem do falecido frente à tecnologia atual de criar cenas inéditas. A pesquisa investiga as lacunas normativas existentes diante dos novos desafios tecnológicos, o respeito à vontade do falecido, a dignidade post mortem e os interesses comerciais envolvidos na reconstrução digital de personalidades públicas. Com respaldo na revisão bibliográfica, revisando a literatura existente sobre o tema, incluindo livros, artigos científicos, e notícias, são abordados os direitos de personalidade, os impactos da deepfake post mortem de celebridades, bem como as implicações éticas e jurídicas. Conclui-se que a autorização dos herdeiros e sucessores não encerra o controle da legitimidade do uso da imagem do falecido, pois é necessário observar se a utilização está em conformidade com os valores, princípios e convicções manifestadas pelo titular da imagem, evitando-se distorções, usos abusivos ou finalidades contrárias à sua memória e identidade.
dc.description.abstract2This study addresses the ethical and legal boundaries of using the image of deceased individuals through artificial intelligence, particularly with the application of deepfake technology, which has enabled what is referred to as "digital resurrection." It is based on the premise that personality rights, although non-transferable and non-waivable, may have economic reflections even after death. This raises questions regarding the legitimacy of heirs in the economic exploitation of the deceased's image in light of current technology capable of recreating previously unseen scenes. The research explores existing legal gaps in the face of new technological challenges, the respect for the will of the deceased, post-mortem dignity, and the commercial interests involved in the digital reconstruction of public figures. Supported by bibliographic review, including books, scholarly articles, and news sources, the study examines personality rights, the impact of post mortem deepfakes involving celebrities, as well as the ethical and legal implications. It concludes that the authorization granted by heirs and successors does not exhaust the legitimacy control over the use of the deceased's image. It is essential to assess whether such use aligns with the values, principles, and convictions previously expressed by the image’s holder, avoiding distortions, abusive practices, or purposes contrary to their memory and identity.
