| dc.description.abstract | A palavra é o instrumento do operador do Direito. Por isso, este trabalho tem como objetivo apresentar uma reflexão sobre a linguagem usada no Direito e na Ciência Jurídica. De início, dirigi-se o estudo para ciência da linguagem, em especial, na distinção entre os campos sintático, semântico e pragmático, como também, na relação entre o texto e o contexto. O Direito é um sistema comunicacional que utiliza uma linguagem diversificada, do geral para o sentido mais específico. Constatou-se que o Direito, além da linguagem técnica, possui uma linguagem enviesada, rebuscada, de difícil comunicação entre os interlocutores, principalmente, para o cidadão comum. Tendo por base a Constituição de 1988, especialmente, pela sua origem e renovação democrática, analisaram-se alguns incisos do Artigo 5º. Essa análise permitiu constatar o uso do JURIDIQUÊS no texto constitucional, como um dos elementos que dificultam a compreensão do texto jurídico e sua aplicabilidade na vida prática. Esses fatos permitiram a criação de um desconhecimento ou não-compreensão do Direito para àqueles a quem a norma, em geral, é dirigida, apontando o distanciamento entre o texto legal e a linguagem do homem comum em situações comunicativas e discursivas, por exemplo, os termos jurídicos usados no Artigo 5º da Constituição Federal de 1988. A concretização dos direitos fundamentais perpassa primeiro pela regra hermenêutica da interpretação gramatical contribuindo assim, para que a norma tenha eficácia social ou efetividade plena no meio da sociedade. | pt_BR |
| dc.description.abstract2 | The word is an instrument of Law operator. Therefore, this work has aim to show a reflection about the language used in the law and in the juridical science. First of all, turn the study to the language science, in special, in the distinction between the syntax, semantic and pragmatic area, as well as, in the relation between the text and the context. The law is a system of communication that utilize a diversify language, of general to the specific. Noticed that the law, besides technical language, has an oblique language, refined, of difficult communication between the interlocutors, principally, to the common citizen. Based on Constitution of 1988, specially, by its origin and democratic renovation, analyzed some incisions of 5º article. This analysis permitted to verify the use of JURIDIQUÊS in the constitutional text, as an element that difficult the comprehension of the juridical text and its application in the practice life. These facts permitted the creation of a no comprehension of law to the people who the general rule is directed, pointing to the distance between the legal text and the language of the common man in communicative and discursive situations, for example, the juridical terms used in the 5º article of Federal Constitution of 1988. The realization of the fundamental law to pass by in the first place by hermeneutic rule of the grammatical interpretation contributing in this way, to that norm has social efficacy or be completely effective in the society. | |
