| dc.description.abstract | Nada obstante o assédio moral no âmbito trabalhista seja vivenciado desde o surgimento do trabalho, nos últimos 30 anos, tal temática ganhou notória relevância social, frente aos movimentos de empoderamento e apoio às vítimas. Ainda assim, em que pese a crescente de debates sobre o tema, o assédio moral ainda é matéria carente, no ordenamento jurídico brasileiro, de qualquer vigor legal – pela ausência de tipo penal, e jurisprudencial – pelas dificuldades inerentes à materialidade do fato. À vista disto, esse trabalho se propõe a analisar quais são, na prática, as dificuldades inerentes à comprovação e ao combate ao assédio moral trabalhista, partindo da premissa de que a prática odiosa, em sua existência, comporta diversos critérios que contribuem para o deslinde judicial do feito, ao passo em que o próprio silêncio legislativo contribui para a impunidade do sujeito assediador, ao beneficiá-lo. O presente estudo, efetuado com revisão bibliográfica, pretende conceituar e compreender o que, de fato, é o assédio moral, estudando-o a fim de entender se há nexo causal entre suas particularidades e a dificuldade de punição ao sujeito assediador. Revela-se a importância de presente trabalho em virtude da repercussão social do mesmo, eis que as relações de trabalho e hierarquia são patentes em nossa sociedade contemporânea, tanto no âmbito privado, quanto no serviço público. | pt_BR |
| dc.description.abstract2 | Despite the fact that moral harassment in the work environment has been experienced since it was related to work, in the last 30 years, this treaty has gained social notoriety, in the face of movements of empowerment and support for victims. Even so, despite the growing number of debates on the subject, moral harassment is still a subject lacking, in the Brazilian legal system, any legal force – due to the absence of a criminal type, and jurisprudence – due to the difficulties inherent to the materiality of the fact. In view of this, this work proposes to analyze what are, in practice, the difficulties inherent in proving and combating workplace bullying, starting from the premise that the hateful practice, in its existence, includes several criteria that obeyed for the delineation of the deed, while the legislative silence itself contributes to the impunity of the assessor, by benefiting him. The present study, carried out with a bibliographic review, intends to conceptualize and understand what, in fact, moral harassment is, studying it in order to understand if there is a causal link between its particularities and the difficulty of punishing the harassing subject.
