dc.description.abstractO presente trabalho aborda o prolongamento artificial da vida e o limite decisório do paciente, analisando a tensão bioética e jurídica na terminalidade. A pesquisa norteia-se pelo seguinte problema: até que ponto o prolongamento artificial da vida respeita a autonomia dos sujeitos envolvidos no processo e se alinha ao princípio da dignidade humana e aos desdobramentos bioéticos? O objetivo geral consiste em investigar os aspectos éticos e jurídicos envolvidos na obstinação terapêutica, avaliando o impacto da ausência de regulamentação específica no Brasil e a harmonização entre o dever de proteção à vida e o direito de recusa terapêutica. Com esse intuito, adotou-se o método dedutivo, por meio de pesquisa bibliográfica, que analisou a Constituição Federal, o Código Penal, resoluções do Conselho Federal de Medicina. Os resultados demonstram que a distanásia viola a dignidade da pessoa humana ao impor sofrimento inútil, equiparando-se a tratamento degradante, enquanto a ortotanásia se consolida como a prática lícita e humanitária de cuidado. Conclui-se que, embora a autonomia seja um direito assegurado, sua efetividade é frequentemente prejudicada pela insegurança jurídica e pela prática da medicina defensiva, evidenciando a necessidade imperiosa de legislação federal sobre o estado de terminalidade, para garantir que a tecnologia médica respeite a biografia e o limite decisório do paciente.
dc.description.abstract2This paper addresses the artificial prolongation of life and the patient’s decision-making limit, analyzing the bioethical and legal tension in terminality. The research is guided by the following problem: to what extent does the artificial prolongation of life respect the autonomy of the subjects involved in the process and align with the principle of human dignity and bioethical developments? The general objective consists of investigating the ethical and legal aspects involved in therapeutic obstinacy, evaluating the impact of the absence of specific regulation in Brazil and the harmonization between the duty to protect life and the right to refuse treatment. To this end, the deductive method was adopted, through bibliographic research that analyzed the Federal Constitution, the Penal Code, and resolutions of the Federal Council of Medicine. The results demonstrate that dysthanasia violates the dignity of the human person by imposing futile suffering, amounting to degrading treatment, while orthothanasia consolidates itself as the lawful and humanitarian practice of care. It is concluded that, although autonomy is a guaranteed right, its effectiveness is frequently hindered by legal uncertainty and the practice of defensive medicine, evidencing the imperative need for federal legislation regarding the state of terminality to ensure that medical technology respects the patient's biography and decision-making limit.
